LEGAL SERVICES PROVIDED:
- Often times members already have documents and estate plans in place. We are happy to review these documents for accuracy and to identify potential issues. We are able to review documents including Wills, Power of Attorneys, Trusts, and Real Estate Deeds.
- Documents that we are not able to review include, but are not limited to: Contracts, Legal Agreements, Separation Agreements, Divorce Decrees, and Domestic Relations related documents.
- Deed Retrieval – If you need a copy of a current deed for a property located in the state of Ohio, GWC is able to search the county records and obtain a copy for you.
- Deed Preparation & Recording – GWC can prepare deeds to transfer real estate. GWC can also have the deeds recorded and put on county record to make the transfer of property complete.
- Last Will & Testament – No matter how big or small your estate is, it’s a wise practice to do a Will. A Will directs how you want your probate assets (assets without beneficiary designations) divided and distributed after your death. A Will also names the person who you wish to handle your estate’s matters, also known as an Executor. The Will can also have special provisions like specific gifts, nomination of guardians for minor children, and more. If you pass away without a Will, then the Probate Court will look to Ohio’s law (Ohio Revised Code section 2105.06 – Statute of Descent and Distribution) to determine who stands to inherit your probate estate.
- Power of Attorney (for financial matters) - A Power of Attorney is a very powerful document. It allows the person you name a your “agent” to make decisions and act on your behalf in matters concerning your property, including your money, real estate, bank accounts, and more. This can be an important document to have in place. Without a power of attorney, should you become incapacitated and not able to act for yourself, the person wishing to act on your behalf would need to file for a guardianship in the Probate Court of the county you reside in.
- Health Care Power of Attorney - A Health Care Power of Attorney only goes into effect when an individual is no longer able to make health related decisions for themselves. It allows the person(s) named to make those decisions on your behalf. You can also give specific direction about your health care in the document.
- Living Will Declaration - living will documents your wish to withhold or withdraw life sustaining treatment if you are unable to make informed medical decisions AND are in a terminal condition or in a permanently unconscious state.
- Transfer on Death Designations for your real estate – The Transfer on Death Designation Affidavit is a document that allows your real estate to be transferred to the beneficiary or beneficiaries named in the affidavit, without going through the probate process.
